Flowers and Plant Mall is a web base marketplace for flowers and plants and its accessories (subject to your compliance with the Terms and Conditions set forth below). Please read these Terms and Conditions before using this Web Site.

Advertisers and users are responsible for ensuring that advertising content, text, images, graphics, video (“Content”) uploaded for inclusion on Flowers and Plant Mall website complies with all applicable laws. Flowers and Plant Mall assumes no responsibility for any illegality or any inaccuracy of the Content.

The advertisers and user guarantee that his or her Content do not violate any copyright, intellectual property rights or other rights of any person or entity, and agrees to release Flowers and Plant Mall from all obligations, liabilities and claims arising in connection with the use of or the inability to use the service.

Advertisers agree that their Content can may be presented through Flowers and Plant Mall’s partner sites under the same terms and conditions as on Flowers and Plant Mall.

Copyright

Advertisers grant Flowers and Plant Mall a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such Content or incorporate such Content into any form, medium, or technology now known or later developed.

The materials (including the Content, and any other content, software or services) contained on Flowers and Plant Mall website are the property of Flowers and Plant Mall.com its affiliates and/or third-party licensors. Any intellectual property rights, such as copyright, trademarks, service marks, trade names and other distinguishing brands on the Web Site are the property of Flowers and Plants Mall. Watermarks

All images on Flowers and Plant Mall website are watermarked, which prevents the images to be used for other purposes, without the consent of the advertiser.

Safety and images

Flowers and Plant Mall reserves the right to change the title of the Content, for editorial purposes. Flowers and Plant Mall reserves the right not to publish images that are immaterial or images that violate Flowers and Plant Mall’s rules.

Personal

Flowers and Plant Mall has the right to cooperate with authorities in the case any Content violates the law. The identity of advertisers, users or buyers may be determined, for example by an ISP. IP addresses may also be registered in order to ensure compliance with the terms and conditions.

Privacy

Flowers and Plant Mall will collect information from Users and Advertisers. It is a condition of use of the Flowers and Plant Mall that each User and advertiser consents and authorizes Flowers and Plant Mall to collect and use this information. Flowers and Plant Mall also reserves the right to disclose it to Company Affiliates and any other person for the purposes of administering, supporting and maintaining Flowers and Plant Mall website, as well as for improving Flowers and Plant Mall, for example by using the information for research, marketing, product development and planning.

Cookies

Email address of users

Users are required to submit a valid email address, before they are allowed to post advertisements. The email address of the User shall not be publicly displayed and other users are permitted to send email to the User through Flowers and Plant Mall website.

Links to third party websites

Flowers and Plant Mall may contain links or references to other websites (‘Third Party Websites’). Flowers and Plant Mall shall not be responsible for the contents in Third Party Websites. Third Party Websites are not investigated or monitored. In the event the user decides to leave Flowers and Plant Mall and access Third Party Sites, the user does so at his/her own risk.

Paid content and services

Some content and services of Flowers and Plant Mall require payment, including but not limited to, membership packages, posting of ads in select categories, and sale of items through Doorstep Delivery.

Users may purchase ad promotions using vouchers issued or sold by Flowers and Plant Mall. Vouchers may not be redeemed for cash.

Advertisers and Users may be required to transmit Paid Content information through a third-party service provider, which may be governed by its own terms of use. Links to any third-party service providers is at the Users’ and Advertisers’ own risk and Flowers and Plant Mall disclaims all liability related thereto. Under no circumstances shall Flowers and Plant Mall be obliged to refund any payments made in respect to Paid Content.

Memberships/Vendor

As part of a membership package, Flowers and Plant Mall will create a Shop on behalf of the Vendor. A Shop is a dedicated webpage on Flowers and Plant Mall, maintained by Flowers and Plant Mall, with content provided by the user. Flowers and Plant Mall has the right to any content added to the Shop by the user and has the right to remove or not publish the content if it violates any aspect of the Terms and Conditions.

Flowers and Plant Mall reserves the right to modify or change membership packages, including the price and the contents of the membership package.

Flowers and Plant Mall is not obligated to refund money or services if a membership package is cancelled early, for any reason.

Doorstep Delivery

Doorstep Delivery is an eCommerce service provided by Flowers and Plant Mall to help Buyers get items delivered to their doorstep. In some cases, the delivery and payments are handled by the Seller, while in other cases they are handled by Flowers and Plant Mall. Whether an item will be delivered by the Seller or by Flowers and Plant Mall will be specified in the ad.

Delivery Arrangements

You will receive a phone call to arrange the delivery between the hours of 8am – 5pm Monday to Friday, however, if an arranged delivery is attempted and there is nobody to provide a signature, it will be taken back to the depot and re-delivered on another day but will incur a re-delivery charge which is to be paid direct to the carrier to enable re-delivery of the goods. If possible, it is preferred that you provide a mobile phone number.

A Seller has to be a Member on Flowers and Plant Mall to opt into the Doorstep Delivery service. For Seller-related Terms and Conditions, please contact the seller on their contact number provided. To become a member on Flowers and Plant Mall, please create an account

By placing a ‘Doorstep Delivery’ order, Buyers undertake to purchase the item unless it is materially different from the description provided by the Seller on Flowers and Plant Mall. If the delivered item is not as described in the ad, then the Buyer is entitled to a free replacement of the product under Flowers and Plant Mall’s Buyer Protection policy. Buyers also understand that especially flowers and plants Photo’s image listed on the website may not necessarily look as the picture posted on flowers and Plant mall website.

Flowers and Plant Mall does not provide any guarantees that Sellers/vendors have been truthful or accurate in their listings, have items in stock, will accept the return of the item, or provide any refunds. Flowers and Plant Mall is not responsible for unsatisfactory or delayed performance, losses, damages or delays as a result of items being unavailable or mishandled by Sellers.

Flowers and Plant Mall reserves the right to suspend, limit or withdraw access to Flowers and Plant Mall and/or Membership of any user who does not comply with these terms.

Disclaimer

Flowers and Plant Mall assume no responsibility what so ever for the use of Flowers and Plant Mall and disclaims all responsibility for any injury, claim, liability, or damage of any kind resulting from or arising out of or any way related to (a) any errors on Flowers and Plant Mall or the Content, including but not limited to technical errors and typographical errors, (b) any third party web sites or content directly or indirectly accessed through links in Flowers and Plant Mall, (c) the unavailability of Flowers and Plant Mall, (d) your use of Flowers and Plant Mall or the Content, or (e) your use of any equipment (or software) in connection with Flowers and Plant Mall

Indemnification

Advertisers/Vendors and users agree to indemnify Flowers and Plant Mall as well as its officers, directors, employees, agents, from and against all losses, expenses, damages and costs, including attorney’s fees, resulting from any violation of this Terms and Conditions (including negligent or wrongful conduct).

Modifications

Flowers and Plant Mall reserves the right to modify these Terms and Conditions. Such modifications shall be effective immediately upon posting on Flowers and Plant Mall. You are responsible for the reviewing of such modifications. Your continued access or use of Flowers and Plant Mall website shall be deemed your acceptance of the modified terms and conditions.

Governing law

Flowers and Plant Mall is operated under the laws and regulations of Ghana. All matters, dispute arising out of the use of this website shall be resolve amicable between the aggrieved parties. Should such settlement failed, the disgruntled party shall resort to the laws of Ghana.
